Proposed post-recoupment participation
One model for negotiation is a 50/50 division of the agreed distributable proceeds after recovery of approved, documented costs. The cost categories, caps, reporting basis and payment schedule would need to be defined in the film agreement.
Agree the sequence of exploitation
The parties may discuss an original-language release first and localized versions later, where the necessary permissions exist. Any exclusivity, approval rights, licence term and treatment of newly created language assets must be agreed expressly.
